Terms of Use
These terms are the agreement between you and Jake Williams, doing business as Kesin (“Kesin,” “we,” “us”), for the Kesin mobile app and the getkesin.app website. Please read the sections on connected accounts, data accuracy, and limitation of liability carefully — they define what Kesin is responsible for and what it is not. By creating an account or using Kesin, you accept these terms. If you do not accept them, do not use Kesin.
Kesin is a record-keeping tool. It does not hold your money, does not place trades, does not tell you what to trade, and is not affiliated with Kalshi or Polymarket. Market data shown in the app comes from third parties and can be delayed, incomplete, or wrong. Every trading decision is yours alone.
01What Kesin is — and what it is not
Kesin is an independent portfolio tracker and trade journal for prediction markets. It lets you log positions, view estimated profit and loss, track upcoming resolutions, keep notes, set price alerts, and — if you choose to connect an account — import your positions automatically.
Kesin is not a broker, dealer, exchange, futures commission merchant, designated contract market, investment adviser, or financial institution. Kesin does not:
- Hold, transmit, custody, or have access to your funds
- Place, modify, cancel, or route orders or trades
- Offer, solicit, or facilitate any wager, contract, or transaction
- Provide investment, financial, legal, tax, or accounting advice
Your relationship with Kalshi, Polymarket, or any other trading platform is governed entirely by their terms, not these. You are responsible for complying with those terms and with all laws that apply to you, including any restrictions on who may trade on a given platform from your jurisdiction.
02No investment advice
Everything Kesin displays — profit and loss figures, equity curves, calibration scores, closing-line value, attribution breakdowns, whale activity, alerts, and the daily digest — is descriptive analytics about data you or the platforms provided. None of it is a recommendation, endorsement, or solicitation to enter, exit, hold, or size any position, and none of it should be relied on as a basis for any trading decision.
Prediction-market trading involves substantial risk, including the risk of losing your entire stake. Past results shown in Kesin do not predict future results. You are solely responsible for your own decisions, and you should consult a qualified professional before acting on any financial matter.
03Eligibility and your account
You must be at least 18 years old and legally able to enter this agreement. You must provide accurate account information and keep your credentials secure. You are responsible for everything that happens under your account, and you agree to tell us promptly at support@getkesin.app if you believe it has been compromised.
One person, one account. Do not share your account, and do not create accounts to evade a suspension, to obtain repeated free trials, or otherwise to circumvent these terms.
04Connected accounts and API keys
Connecting a trading account is entirely optional — Kesin is fully usable by logging positions by hand, on the free tier, forever. If you do connect one, you authorize Kesin to access that platform on your behalf for the sole purpose of reading your positions and trade history and importing them into your Kesin account.
Kalshi API keys are full-access. Kalshi does not currently issue read-only keys, which means the key you provide is technically capable of placing, modifying, and cancelling trades on your Kalshi account — not merely reading it. Kesin uses it only to read your positions and fills.
We encrypt your key with authenticated encryption before it is stored, decrypt it only inside our server-side functions, and never return it to the app, expose it to any client, or share it with any third party. Even so, no system is perfectly secure, and by connecting you accept the risk inherent in entrusting a full-access credential to any third-party service. If that risk is not acceptable to you — a completely reasonable position — do not connect Kalshi, and log your trades manually instead.
You may revoke access at any time, from either side: disconnect in Kesin (Settings → Connected accounts), which deletes the stored key, and/or revoke the key in your Kalshi account settings. Polymarket is different — it requires only your public wallet address, involves no keys or permissions, and grants no ability to act on your account.
05Market data and accuracy
Kesin displays market data obtained from third-party sources, including Kalshi and Polymarket. That data is provided to you as-is. It may be delayed, incomplete, inaccurate, unavailable, or withdrawn without notice, and the third parties who provide it may change or discontinue their services at any time.
Prices, valuations, and profit-and-loss figures shown in Kesin are estimates. Thin, wide, or empty order books in particular can produce values that differ substantially from what you could actually transact at, and settled or disputed markets may be reflected late. Kesin is a record of your activity, not an authoritative statement of your account. Your platform's own records are authoritative — always reconcile against them for anything that matters, including taxes.
Notifications, alerts, and digests are delivered on a best-effort basis through third-party services and may be delayed, duplicated, or not delivered at all. Do not rely on them as your only means of monitoring a position.
06Subscriptions and billing
Kesin offers a free tier and an optional paid subscription (“Kesin Premium”). Premium subscriptions are sold through the Apple App Store and billed to your Apple ID.
- Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours of the period ending.
- Free trials. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial.
- Managing and cancelling. Manage or cancel at any time in your device Settings → your name → Subscriptions. Cancelling stops future renewals; you keep Premium until the end of the paid period.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds for App Store purchases — request them through Apple.
- Price and feature changes. We may change prices or the features included in each tier. Price changes affecting an existing subscription take effect no earlier than the next renewal, with notice, and you may cancel before then.
07Acceptable use
Do not: access Kesin other than through the app and website we provide; probe, scan, or attempt to breach our systems or another user's account; scrape, resell, or redistribute data obtained through Kesin; reverse engineer or attempt to extract source code or credentials; interfere with or place unreasonable load on our infrastructure or the third-party APIs Kesin relies on; upload unlawful content; use another person's trading credentials; or use Kesin for any unlawful purpose.
08Your content
Your positions, journal entries, notes, and tags remain yours. You grant us only the limited licence needed to store, process, and display that content in order to operate Kesin for you. We do not sell it and do not use it for advertising. How we handle it is described in our Privacy Policy, which is part of these terms.
09Our intellectual property; third-party marks
Kesin, the Kesin name and logo, and the app's software, design, and content are owned by us and protected by intellectual-property laws. These terms grant you a personal, non-exclusive, non-transferable, revocable licence to use Kesin for your own non-commercial purposes, and nothing more.
“Kalshi,” “Polymarket,” and other third-party names and marks belong to their respective owners and are used in Kesin only to identify those platforms. Kesin is not affiliated with, endorsed by, sponsored by, or connected to Kalshi, Polymarket, Apple, or any trading platform or exchange.
10Third-party services
Kesin depends on third-party services — among them Apple, Supabase, RevenueCat, Expo, Kalshi, and Polymarket — and on APIs those platforms control. Those services may change, degrade, restrict access, or shut down at any time, which may impair or disable parts of Kesin without notice. We are not responsible for third-party services, their content, or their acts and omissions.
11Availability, changes, and termination
We may modify, suspend, or discontinue any part of Kesin at any time. We may suspend or terminate your account if you breach these terms, if we reasonably suspect fraud or abuse, or if required by law.
You may stop using Kesin at any time and delete your account in the app (Settings → Delete account), which permanently removes your account and associated data. Cancelling a subscription is separate and is done through Apple. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, and dispute resolution — do survive.
12Disclaimer of warranties
KESIN IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Kesin will be uninterrupted, secure, timely, or error-free; that any data, price, calculation, or notification will be accurate, complete, or delivered; or that defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
13Limitation of liability
To the fullest extent permitted by law, we are not liable for any trading losses, lost profits, lost opportunities, lost or inaccurate data, or any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to Kesin, whether based in contract, tort, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
This expressly includes losses arising from: inaccurate, delayed, missing, or unavailable market data or profit-and-loss figures; any alert, digest, or notification that was delayed, duplicated, or never delivered; any position imported incorrectly, imported late, or not imported at all; and any decision you made in reliance on anything displayed in Kesin.
Our total aggregate liability for all claims relating to Kesin is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
14Indemnification
You agree to indemnify and hold harmless Jake Williams, doing business as Kesin, and his agents and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of Kesin, your content, your breach of these terms, your violation of any law or third-party right, or your activity on any trading platform.
15Dispute resolution and arbitration
Please read this section carefully — it affects how disputes between us are resolved and limits your right to go to court or participate in a class action.
First, let's try to fix it: before starting any formal proceeding, you agree to contact us at support@getkesin.app with a description of the dispute and to negotiate in good faith for at least 30 days.
If that fails, any dispute arising out of or relating to these terms or Kesin will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in North Carolina or, at your election, conducted remotely or in the county where you live. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. Disputes will be brought only in an individual capacity. You and we each waive any right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to our systems.
Your right to opt out. You may reject this arbitration agreement by emailing support@getkesin.app with the subject “Arbitration Opt-Out” within 30 days of first accepting these terms. Opting out does not affect any other part of these terms, and it will not affect your access to Kesin.
16Governing law
These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Where these terms permit court proceedings, they take place in the state or federal courts located in North Carolina, and both parties consent to that jurisdiction. Nothing here deprives you of the protection of mandatory consumer-protection laws of the place where you live.
17Apple
These terms are between you and us, not Apple, and Apple is not responsible for Kesin or its content. Apple has no obligation to provide support or maintenance for Kesin. In the event of any failure to conform to a warranty, you may notify Apple for a refund of the purchase price, if applicable; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to Kesin, including product-liability, regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
18General
These terms, together with the Privacy Policy, are the entire agreement between you and us about Kesin. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
We may update these terms. Material changes will be reflected in the “Last updated” date above and, where appropriate, notified in the app. Continuing to use Kesin after a change takes effect means you accept the updated terms; if you do not, stop using Kesin and delete your account.
